Terms & Conditions

Please read these terms carefully before engaging Prestige Roofing Solutions Pty Ltd for any roofing work or using our website.

Last updated: October 2026

1Introduction & Acceptance

These Terms & Conditions apply to all roofing, restoration, repair, cleaning, guttering, pergola and related services supplied by Prestige Roofing Solutions Pty Ltd (ABN 37 649 492 811) and to your use of our website at prestigeroofingsolutions.com.au.

By requesting a quote, accepting a quote, signing a contract, paying a deposit or allowing us to start work, you confirm that you have read, understood and agreed to these terms. If a signed written contract contains terms that differ from these, the signed contract prevails to the extent of the difference.

2Definitions

  • "We", "us", "our" means Prestige Roofing Solutions Pty Ltd.
  • "You", "Client" means the person or entity requesting or receiving our services, including the property owner or their authorised representative.
  • "Services" means all work, labour, supply of materials and advice provided by us.
  • "Quote" means a written price and scope of work issued by us.
  • "Site" means the property where the Services are to be carried out.

3Quotes & Estimates

  • On-site inspections and written quotes are provided free of charge and without obligation.
  • Quotes are valid for 30 days from the date of issue unless stated otherwise. After that, we may update pricing to reflect material or labour cost changes.
  • Quotes are based on the conditions we can see at the time of inspection. Hidden defects such as rotted battens, damaged timber, or concealed leaks may only be discovered once work begins (see Variations).
  • Verbal estimates are a guide only and do not form a binding offer.

4Contracts & Licensing

We hold the licences required to carry out roofing work in New South Wales. In accordance with the Home Building Act 1989 (NSW):

  • Residential building work valued at more than $20,000 (including labour and materials) must be covered by a written contract signed by both parties before work starts.
  • Work valued at more than $5,000 is only carried out by appropriately licensed contractors.
  • A written Quote that you accept in writing, by email, or by paying a deposit forms a binding agreement for smaller jobs.
Our licence number is shown on every Quote and contract. You can verify any NSW contractor licence on the NSW Fair Trading website.

5Pricing, GST & Payment

  • All prices are in Australian dollars (AUD) and include GST unless clearly stated otherwise.
  • Payment terms, including progress payments, are set out in your Quote or contract. Where none is stated, the balance is due on completion of the work, before or at the final walkthrough.
  • Accepted payment methods will be listed on your invoice (such as bank transfer).
  • Overdue amounts may incur reasonable interest and recovery costs, including legal and debt collection fees, to the extent permitted by law.
  • Ownership of supplied materials remains with us until the invoice is paid in full.
  • For commercial work, the Building and Construction Industry Security of Payment Act 1999 (NSW) may apply to payment claims.

6Deposits

A deposit may be requested to secure your booking and order materials. For residential building contracts over $20,000, the deposit will not exceed 10% of the contract price, as required by NSW law. Deposit amounts for smaller jobs will be stated in your Quote.

7Variations

  • Any change to the agreed scope, materials, colours or specifications is a variation.
  • If we discover unforeseen issues once work begins, we will stop, explain the problem, and provide a written variation price before proceeding.
  • Variations that affect price or time must be agreed in writing (email or text message is acceptable) before the extra work is carried out.

8Site Access & Client Responsibilities

To allow work to proceed safely and efficiently, you agree to:

  • Provide safe, clear access to the Site, roof and ladder or scaffold positions.
  • Move vehicles, outdoor furniture, pets, plants and valuables away from work areas.
  • Provide access to water and power if required for the job.
  • Obtain any body corporate, strata, landlord or neighbour consents required.
  • Tell us about any known hazards, such as asbestos, solar panels, aerial cabling or fragile roof sections.

Where council approval or a development/complying development certificate is required (for example, for heritage properties, changes to roof pitch or roofline, or some pergolas and carports), we will advise you, and obtaining approval is the property owner's responsibility unless agreed otherwise in writing.

9Weather & Delays

Roofing is weather dependent. Rain, high winds, storms, extreme heat and unsafe site conditions may delay or pause work. Estimated start and completion dates are a guide only. We will keep you informed of any delay and will not be liable for delays caused by weather, supplier shortages, site access problems, or other events beyond our reasonable control.

10Asbestos & Hazardous Materials

Many Australian homes built before the mid-1980s may contain asbestos in roofing, eaves, gutters or flashing. Our Quotes do not include the removal or disposal of asbestos or other hazardous materials.

  • If we suspect asbestos at the Site, work will stop immediately.
  • Testing, removal and disposal must be carried out by a licensed asbestos removalist in line with SafeWork NSW requirements.
  • Costs and delays resulting from the presence of asbestos or hazardous materials are the Client's responsibility.

11Materials & Manufacturer Warranties

We supply quality materials from established suppliers such as Colorbond, BlueScope, Lysaght, Monier, Stratco and VELUX. Materials are covered by the manufacturer's own warranty, which is separate from our workmanship warranty. Manufacturer warranty terms, conditions and exclusions apply, and we will provide the relevant details on request. Minor colour, texture or batch variations between samples and delivered products may occur and are not defects.

12Workmanship & Statutory Warranties

  • We provide a 7-year workmanship guarantee on new roof installations. This covers defects in our labour and installation.
  • For residential building work in NSW, statutory warranties under the Home Building Act 1989 also apply, including 6 years for major defects and 2 years for other defects, from completion of the work.
  • Warranties do not cover damage caused by storms or natural disasters, normal wear and tear, lack of maintenance, alterations by others, foot traffic, or misuse after completion.
  • To make a warranty claim, notify us in writing as soon as you become aware of a problem. We will inspect and, where the defect is covered, rectify it within a reasonable time.
Roofs need regular maintenance to remain under warranty. We recommend annual inspections and gutter cleaning.

13Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). These include that services will be provided with due care and skill, be fit for purpose, and be completed within a reasonable time.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If you have a major failure with a service, you are entitled to remedies set out in the ACL.

14Cancellation & Cooling-Off

  • For residential building contracts over $20,000, you have a cooling-off period of 5 business days after signing the contract, as provided by the Home Building Act 1989 (NSW). Written notice of cancellation must be given within this period.
  • If you cancel during the cooling-off period, we will refund your deposit, less any amount allowed under law.
  • Outside the cooling-off period, or for smaller jobs, cancellation requires written notice. Where materials have been ordered or work has started, you may be liable for reasonable costs incurred, including non-returnable materials and work completed.
  • We may cancel or suspend work if unsafe site conditions, unpaid invoices, or access issues make it unreasonable to continue.

15Liability & Insurance

We carry public liability insurance and workers' compensation insurance for all work. Certificates of currency are available on request.

  • To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit or loss of use.
  • Where liability cannot be excluded, our liability for breach of a consumer guarantee is limited, where the law allows, to re-supplying the services or paying the cost of having them re-supplied.
  • We are not responsible for pre-existing defects, concealed conditions, or damage caused by the work of others.
  • Inspections are visual only and are not structural engineering or building certification reports.

16Complaints & Dispute Resolution

If you are unhappy with any aspect of our service, please tell us as soon as possible so we can fix it. Contact us by phone or email with your name, address and a description of the issue. We aim to acknowledge complaints within 2 business days and work with you toward a fair solution.

If we cannot resolve the issue, you may contact NSW Fair Trading (fairtrading.nsw.gov.au or 13 32 20) for free dispute resolution assistance. Both parties agree to attempt good-faith resolution before starting legal proceedings.
